The MRO Board Hearing Body has authority to conduct hearings and render decisions on compliance issues in which a registered entity contests the finding of an alleged violation, proposed penalty or sanction or a proposed mitigation plan. The details of the hearing process and duties of the Hearing Body are identified in the Compliance Monitoring and Enforcement Program and through the Hearing Procedures duly adopted by the MRO.
Additionally, the Hearing Body is responsible for the review and approval of settlement agreements negotiated by MRO staff on behalf of the organization. The review is limited to a determination of whether the facts represent a violation of a Reliability Standard and whether the negotiated resolution is fair and reasonable. The Hearing Body is not authorized to change the terms of a proposed settlement.
